These Terms & Conditions ("Terms") govern the use of this website and the general terms under which C&C Global Traders BV ("the Company") engages with business customers ("Buyer") regarding the supply of natural minerals. Specific commercial terms for any order (price, quantity, Incoterms®, delivery, payment) will be confirmed separately in a written quotation, order confirmation or sales contract, which shall prevail over these general Terms in case of conflict.
The Company supplies minerals exclusively to business customers (B2B) for industrial and commercial use. These Terms do not apply to consumer transactions.
Products offered — Calcined Bauxite, Chamotte, Kaolin Clay and Bentonite Clay — are natural minerals, and minor variations in grade, particle size, moisture or appearance may occur between batches. Specific product grades and specifications will be confirmed in writing (quotation, data sheet or contract) prior to order confirmation.
Quotations issued by the Company are valid for the period stated therein and are subject to availability. An order is binding once confirmed in writing by both parties.
Delivery terms (e.g. FOB, CIF, DAP, etc., per Incoterms® 2020) will be agreed per order. Delivery dates are estimates and not guaranteed unless explicitly agreed in writing.
Prices are quoted exclusive of VAT unless stated otherwise and are subject to applicable Belgian/EU VAT rules, including reverse-charge mechanisms for intra-EU B2B supply where applicable. Payment terms will be specified in the order confirmation.
Ownership of goods supplied remains with the Company until full payment has been received, to the extent permitted under applicable law.
The Company's liability is limited to direct damages arising from a proven breach of contract, and shall not exceed the value of the relevant order, except in cases of gross negligence or wilful misconduct, or where mandatory law provides otherwise.
Neither party shall be liable for failure to perform obligations due to circumstances beyond its reasonable control, including but not limited to shipping disruption, port congestion, export/import restrictions or natural disasters.
These Terms are governed by Belgian law. Any dispute not resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Antwerp, Belgium.
